Terms & Conditions
These Terms govern access to and use of Buyonder's website, applications, live shopping sessions, and related services. By using the service, the user agrees to these Terms.
Eligibility and minors
The service is intended for adults who are 18 years of age or older. A person under 18 may use the customer-facing service only with the supervision, permission, and authorization of a parent or legal guardian, and that parent or legal guardian is responsible for the minor's activity on the service.
All Shoppers and all cardholders must be at least 18 years of age.
The Buyonder service
Buyonder is a live, agent-assisted global shopping platform focused on authentic apparel, footwear including sneakers, handbags, and fashion accessories.
Customers can interact with verified local Shoppers through live video and audio, including a Shopper's point-of-view feed from compatible smart glasses, to review products in real time before approving a purchase.
Limited purchasing-agent relationship
For each approved shopping mission, the customer appoints Buyonder and the assigned verified Shopper as limited purchasing agents solely to locate, inspect, and purchase the customer-approved item from the approved merchant.
This authority is limited to the approved product, merchant, maximum amount, country, time period, and transaction count. Shoppers do not own customer funds and may not withdraw, transfer, or use them personally. Shopper compensation is separate from product funds.
Buyonder does not take title to the merchandise unless a particular transaction expressly states otherwise.
Product and purchase approval
Before any purchase is made, the customer must approve the product, the size or variant, the condition when relevant, the merchant, the item price, the disclosed Buyonder fees, the estimated shipping, and any applicable sales taxes.
No material substitution or material price increase may be made without renewed customer approval. Product availability is not guaranteed until the retailer completes the sale.
Prices, payments, and currency conversion
Buyonder may accept supported cards, digital wallets, and supported stablecoins or other payment methods.
Prices may include the retailer price, Buyonder service fees, shipping, applicable sales taxes, foreign-exchange costs, and other charges disclosed before approval. Prices do not include customs duties, tariffs, import taxes, brokerage charges, or similar cross-border fees. The customer is responsible for all such amounts assessed by customs authorities, carriers, or other third parties.
Exchange rates and third-party processing fees may change. Funds provided for a mission are transaction-specific purchasing funds and are not a bank deposit, a general-purpose stored-value account, or an investment account.
Shopper purchasing cards
Buyonder may make a restricted virtual or physical business purchasing card available to a Shopper for an approved mission. Controls may include spending limits, merchant or merchant-category restrictions, geography, time window, and transaction count.
The card remains Buyonder-controlled at all times, may be frozen or revoked at any time, and may not be used for cash access, personal purchases, transfers, or any unapproved transaction.
Authenticity and product condition
Buyonder permits purchases only from established or otherwise verifiable retailers or from approved authenticated resale merchants.
A Shopper may visually inspect an item and share information during the live session, but Buyonder does not manufacture products and cannot provide guarantees beyond applicable law and any warranty or authenticity commitment provided by the retailer, manufacturer, or approved authentication provider.
Shipping and delivery
Delivery dates are estimates. Shipping may be performed by third-party carriers and may be affected by customs, weather, merchant delays, address issues, or other events outside Buyonder's reasonable control.
Risk of loss and title pass as required by applicable law and the disclosed transaction terms.
International purchases, customs, and taxes
Customs duties, tariffs, import taxes, brokerage charges, and similar cross-border fees are not included in Buyonder pricing and are not estimated by Buyonder. The customer is responsible for all such amounts assessed by customs authorities, carriers, or other third parties.
The customer is responsible for ensuring that an item may lawfully be imported into the destination country.
Cancellations
A customer may request cancellation before the retail purchase is completed. After the purchase has been completed, cancellation depends on the original retailer's policy, the fulfillment status, and applicable law.
Buyonder may cancel a mission because of unavailability, suspected fraud, safety concerns, prohibited products, sanctions, payment failure, or legal or provider restrictions.
Returns, exchanges, and refunds
Returns and exchanges are governed primarily by the original retailer's return and exchange policy and by applicable consumer law. Buyonder may assist with a return but cannot guarantee that the retailer will accept it.
The customer may be responsible for return shipping, duties, restocking fees, or nonrefundable charges disclosed by the retailer or required by law. Any refund is issued after the retailer accepts the return and the returned funds are received and processed.
Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
Prohibited products and merchants
All transactions must comply with Buyonder's separate Prohibited Items & Merchants Policy, which is incorporated into these Terms by reference.
Buyonder may refuse, cancel, or suspend any transaction or account that violates that policy.
Customer conduct and live sessions
Users must treat Shoppers respectfully. Users may not request illegal activity, harassment, discrimination, sexual content, dangerous conduct, off-platform payment, manipulation of card controls, recording in violation of law, or purchases outside the approved mission.
Live shopping sessions may be recorded or monitored only when this is disclosed and permitted by applicable law.
Accounts and verification
Users must provide accurate information, protect their account credentials, and complete identity, payment, sanctions, or fraud checks when required.
Buyonder may limit, suspend, or terminate access if information is false, if verification fails, or if activity appears to be unlawful or unsafe.
Third-party services
Retailers, payment processors, card networks, wallet providers, stablecoin providers, authentication services, carriers, and other third parties operate under their own terms and policies.
Buyonder is not responsible for the independent acts or outages of those third parties except to the extent required by law.
Intellectual property
Buyonder's brand, software, site content, and service materials belong to Buyonder or its licensors.
Users receive only a limited, revocable, nontransferable right to use the service for its intended purpose.
Disclaimers
To the fullest extent permitted by law, the service is provided on an “as is” and “as available” basis. Buyonder does not guarantee uninterrupted availability, inventory, retailer performance, delivery timing, or that every requested item can be sourced.
Nothing in this section excludes or limits any warranty that cannot legally be excluded or limited under applicable law.
Limitation of liability
To the extent permitted by applicable law, Buyonder and its officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits, lost savings, or loss of data, arising out of or relating to the service or these Terms, even if Buyonder has been advised of the possibility of such damages.
This limitation does not apply where it is prohibited by law, and it does not limit any liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer-protection law. Where applicable law permits only a partial limitation, Buyonder's liability is limited to the fullest extent that law allows.
Suspension and termination
Buyonder may restrict or end access to the service for violation of these Terms or for fraud, safety, legal, sanctions, payment, or provider-risk reasons.
Provisions that by their nature should survive termination, including those relating to payment obligations, intellectual property, disclaimers, limitation of liability, and governing law, continue to apply after termination.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
This choice of law does not deprive the user of any mandatory consumer protections or jurisdictional rights that apply under the laws of the user's country or state of residence.
Changes
Buyonder may update these Terms from time to time and will post a revised Last Updated date when it does so. Material changes will be communicated when required by law.
Continued use of the service after the effective date of revised Terms constitutes acceptance of the revised Terms where permitted by applicable law.
